This blog is testament to the dedication and tenacity of one man, Jaco van Heerden, in his valiant fight to get justice for his company – Armour Technology Systems (ATS) – against US defence contractor Navistar Defense.
In the process, this blog will also highlight the US government’s actions, or inaction, in the matter – firstly by not following its own policy regarding the awarding of tenders to parties that are involved in associated legal action, it has rewarded and allowed Navistar to get away thus far with the actions that are exposed in this blog.
Secondly, the US government has avoided its constitutional and legal obligations to investigate criminal charges filed by ATS against Navistar Defense in October 2008. (These are serious charges that include allegations of tender fraud and contraventions of ITAR regulations.)
This blog lists press releases, as well as a summary of unethical and illegal actions by Navistar relating to its actions during and after its relationship with ATS. It also includes an overview of witness statements under oath and supporting documentation, showing how Navistar has acted in bad faith and committed statutory transgressions. We hope this critical information will constitute sufficient evidence for the US government to finally proceed with the requested criminal investigation.
We hope this blog will also raise public awareness and generate media interest to follow up with the US government in support of the South African government’s official request to the US government for a public investigation into the criminal charges.
Such investigation in any case will deal with and confirm the aspects mentioned in this blog.
We hope that the criminal case that will follow such public investigation will be sufficient that Navistar can explain to us, the South African government and the world: when are you going to honour your contractual obligations towards ATS?
This blog will keep the international audience up to speed regarding developments as they happen.
ACTION NOW: We all await the announcement of the US government that it will conduct an open investigation into the criminal charges laid against Navistar by ATS. Until such time we will ask all role-players to keep maximum pressure on the US government to finally fulfil its constitutional and legal obligations in this regard!
